Possibly a little too close to the power line behind it, but hard to tell for sure the distance. That's what I see.

This is code in my area.
Overhead electrical lines must not be located
above the pool or spa and the area extending 10 feet
horizontally from the inside walls.

FWIW that power line is probably 30+ feet away, optical illusion.

Half right. The cover locks are broken off the spa, violating ASTM standards. Therefore the fence would need to be 4' tall to prevent entry of children under the age of 5 (along with all the other fencing rules).
